- GENERAL
These Terms and Conditions are component part of the agreement between the Company „Nadalina“, obrt za taksi prijevoz na vodi, („ToDo Dubrovnik“), Suđurađ 36, 20223 Šipanska Luka, MBO:97828645, OIB:83789935167, (Hereinafter: the Company) and the Customer. Terms and Conditions define the rights and obligations of both parties of the agreement. By any reservation made, both Company and Customer immediately agree to be legally bound by this Terms and Conditions. By making a reservation, the Company instantly implies full and unreserved acceptance of these Terms and Conditions on behalf of the persons named in the booking. These Terms and Conditions apply to all reservations made by sending online request, all reservations made via e-mail, all reservations made via telephone. - BOOKING
Our services can be booked by a person or by group. The Customer can book our services by sending an online request on www.todo-dubrovnik.com also by contacting the Company directly via e-mail at info@ todo-dubrovnik.com. After informing about your choice of the service, date, a number of persons, the Company will reply with confirmation of the service(s) availability and other necessary details. If the preferred date(s) or service(s) are not available, Company will recommend a suitable alternative. The Company is obligated to provide the Customer with advice in choosing a suitable service, but the Customer is fully responsible for his choice. Once the service along with the availability of date and payment method are confirmed, Company will send a final confirmation of the reservation in writing containing all the necessary details. The voucher is made exclusively by the Company containing all the necessary and legal items written. - CHANGES TO RESERVATION AND EXECUTION OF THE CONTRACT
Any change by the Customer must be made in writing, by e-mail at info@todo-dubrovnik.com, or directly, by a telephone call (num. listed on Website). If the change is announced in a telephone conversation between the parties, the Company is obligated to confirm the change in writing, via e-mail. Changes in the reservation which made a change in the number of persons, the date of the service, or chosen service(s) must be made as soon as possible, no later than one day before the date of service in order for the Company to have a fair time to adapt and arrange the reservation according to the change made by the Customer. The Company reserves the right to adjust the price according to the change(s) in the reservation. The services highly depend on the weather forecast and sea conditions, therefore Company reserves the right to change the date of the departure/start due to safety reasons. In case of unfavorable weather and/or sea conditions, the Company will organize the service on the next suitable date or will cancel the tour if the new date or conditions does not suit the Customer. Company reserves the right to change the route as well as start and/or end point during the service if weather and/or sea conditions come to be unfavorable. For such a change, the Customer will be informed in a timely manner by Company’s representative. - CANCELLATION AND POSTPONING OF THE SERVICE
Any cancellation from the Customer must be made in written form by e-mail at info@todo-dubrovnik.com, telephone message (whatsapp, viber, SMS,..) and in a fair time. After receiving a cancellation, the Customer will get confirmation ASAP by the Company. Cancellation more than 48 hours in advance for a full refund, more than 24 hours in advance for 70% refund. For cancellations less than 24 hours prior to start of our service(s), Company is not obliged to reduce the price. Credit card processing fees will not be refunded. Please take note that bank transfer requires 3-7 business days. In cases where the Customer must cancel the tour as a consequence of force majeure, the Company will not charge the penalties no matter the time of the cancellation. The Company may require the Customer to provide the confirmation of inability to participate in service he previously reserved. Company has a right to cancel or postpone the service, prior to the departure, if the circumstances are beyond the Company’s control (unfavorable weather or sea conditions, any act of terrorism, political instability, natural disasters, or similar factors) and the service will not be charged. In that case, the Customer will be informed by the telephone number he provided or e-mail address. In case of misconduct during the service, whether or not caused by alcohol or drug consumption, the skipper/tour guide has the right to pause or immediately terminate the trip/tour. Persons who are already under the influence of alcohol/drugs at the start of the tour could be denied to access the service. The Customer’s payment obligation remains existent. According to the previous sentence, serving alcohol onboard for persons under the age of 18 is prohibited and Company reserves the right to request a photo ID. Any unregulated issues will be governed by law of the Republic of Croatia. - RESPONSIBILITY
During the service(s) the skipper/tour guide is always in charge as safety is paramount. The Customer takes all their belongings on board entirely at their own risk. The Company is not responsible for lost, damaged, or stolen luggage, belongings, and other goods during the service. Lost or stolen luggage, belongings, and other goods are to be reported to the relevant police authorities. Any loss or damage to equipment or property owned by the Company will be the Customer’s responsibility, and all replacement and repair costs will be charged in full. On request, all safety equipment can be provided. The Company is not liable for personal injury or damage of any nature, age regardless of its cause, prior, during, or as a result of the trip/tour, as each Customer individually use our service(s) at their own risk.
5.1. CUSTOMERS UNDER 18 YEARS OLD
Children onboard fall under the responsibility of the parent(s), as well as an adult must accompany tour participants under 18 years. For children under two years old, wearing a suitable life jacket is mandatory. Customers must report their presence to Company during the booking or before boarding.
5.2. PREGNANT CUSTOMERS
In order to ensure the safety and well-being of both the pregnant individual and their child, it would be desirable for Customers to voluntarily report their presence, allowing the Company to provide special attention and care. The Company kindly requests that this information be provided during the booking process or prior to boarding. Pregnant Customers assume full responsibility for their participation in our services. Pregnant Customers in advanced pregnancy (6 months and more) are not suggested to participate our boat services.
The Company is not liable for any reason whatsoever in case of injury or any other incident in connection to pregnancy.
5.3. PETS
All pets are welcome. Customer(s) (owner) take full responsibility for them.
5.4. SPECIAL NEEDS TRAVELERS
Company will make reasonable efforts to accommodate the special needs of disabled participants. However, Company cannot guarantee that all services and facilities will be accessible or available for every participant. If Customer have any special needs or require specific accommodations, please to be informed at the time of booking so that Company can provide best to meet Customer(s) requirements. - COLLECTION DATA AND PROTECTION
Company’s priority is the Customer’s privacy. Company is committed to protecting the Customer’s personal information at all times and in all situations. The name, address, and other requested personal information are used only to process reservations. Provided data is available only to authorized officers of company. Data will never be given, rented, sold, or traded for purposes other than order fulfillment. In accordance with the law of the Republic of Croatia, if the authorities have an appropriate legal warrant for access to the Customer’s private data, the Company is obliged to forward the same data. All our business partners and employees are responsible for respecting the principle of privacy protections. Employees and partners commit to discretion and respect for the Customer’s privacy and data. Company uses Google Analytics cookies to get information in order to improve our web site. Cookies do not serve to detect personal information. You can disable cookies in your browser settings. By accepting our terms and conditions, Customer agrees that the Company can use photos and videos taken on the tour across our social media channels and website. - UPDATES & MODIFICATIONS
Company reserves the right to update or modify these terms and conditions at any time without prior notice. Customer(s) are responsible for reviewing the most current version of the terms and conditions before booking a tour. By continuing to use our services after any updates or modifications, Customer agrees to be bound by the revised terms and conditions. - COMPLAINTS
All complaints should be submitted via email to info@todo-dubrovnik.com. The Customer will receive a written response within 7 working days.
